Sources and Checks
Updated 11 October 2026
Di Marco answers Australian workplace relations questions from official sources, then checks each answer after it is written. This page lists every source it uses, how current each one is, and what is checked before you see an answer.
In short. Before it answers, Di Marco is given the real Fair Work Act sections and award clauses for your question and told not to cite any others. After it answers, links are tested, every case is linked to AustLII, and Fair Work Act section numbers are checked against the current Act. Any case or section that can't be confirmed is named in a note under the answer.
The Sources
| Source | What it's used for | How current |
|---|---|---|
| Fair Work Act 2009 (Cth) | Section numbers and headings. The sections that matter for your question are given to Di Marco with their headings, with the rule that no other section number may be cited. | Compilation of 7 July 2026 from legislation.gov.au, all 1,501 sections, loaded 8 October 2026. |
| Modern awards | The clause numbers and headings of 155 modern awards, so a clause cited for an award is one that exists in it. | Each award's table of contents on awards.fairwork.gov.au, 29 September 2026. |
| Case law | Every case cited by its medium neutral citation, such as [2026] FWC 1013, is linked to its page on AustLII, and the page is checked. | Checked when the answer is written. If AustLII doesn't answer the check, the answer says so. |
| Official guidance pages | 45 pages on fairwork.gov.au, fwc.gov.au, legislation.gov.au and safeworkaustralia.gov.au that Di Marco may link to directly. | Each confirmed by hand on 8 October 2026. |
Checks on Every Answer
- Before it answers. Di Marco is given the real section numbers and headings for your question, the clause list for the awards involved, the official pages it may link to, and the rules for citing cases. It is told never to cite a case, section, clause or page it can't verify.
- Links. Every link to an official site is tested after the answer is written. A link that comes back "not found" is removed, and the words are kept.
- Cases. Each case cited with a medium neutral citation gets a link to AustLII, which is checked. A case that can't be found loses the link and is named in a Case check note. If AustLII doesn't answer the check, the case keeps its link and the note says it couldn't be confirmed, so you can open it yourself.
- Fair Work Act sections. A section number cited for the Act that isn't in the current compilation is named in a Section check note.
Drafts for the Commission
From 20 October 2026, the Fair Work Commission requires any document prepared with generative AI to say so and how, and every fact, case and quote in it to be checked. Professional representatives, HR professionals included, must hyperlink every case they cite.
Di Marco's drafts for the Commission end with a "Use of generative AI" paragraph for you to complete, and every case in them is linked. Witness statements are set out for the witness to complete in their own words. If a draft is missing the paragraph, a Before you lodge this note says what to add.
What Di Marco Doesn't Use
- Wikis and other crowd-sourced sites.
- Guesswork about addresses. Di Marco links only to the checked pages above, the Act, and addresses supplied with the sources for your question. Otherwise it names the source without a link.
Limits
- Answers are general HR and industrial relations guidance, not legal advice, and are not reviewed by a person before you see them.
- Di Marco doesn't know your enterprise agreement, policies or arrangements unless you attach them.
- Some official sites refuse automated checks, so a case can't always be confirmed for you. When that happens, the note under the answer says so.
- Check any pay rate or dollar figure against the award or agreement, or with the Fair Work Ombudsman's Pay and Conditions Tool, before you rely on it.
- Open the source for anything consequential, and get independent legal advice when a matter is heading to the Commission or a court.
